Responsible AI & HIPAA Privacy Notice

Access A Doctor uses artificial intelligence (AI) to make care and benefits easier to use. This notice explains, in plain language, what our AI does, what it never does, and how we protect your health information.

1. What our AI assistant is - and is not

  • It is an informational and administrative helper: it can explain your plan, help you find and schedule a visit, help you complete forms, and answer questions about our services.
  • It is not a licensed health care Provider. It does not diagnose, prescribe or change your treatment, and chatting with it does not create a provider-patient relationship. Licensed Providers make clinical decisions.
  • At your direction, it can change your record. When you ask, it can add or update information in your record - for example medications, allergies, medical conditions, surgical history, vitals, personal information and dependents - and can submit urgent-care answers or cancel a consultation. Check what it entered, and tell your Provider if anything is wrong.
  • It can make mistakes. Do not rely on it for medical decisions. Tell your Provider if anything it says concerns you.
  • It is not for emergencies. If you may be having an emergency, call 911. If you are in crisis, call or text 988.
  • Voice calls. AI voice assistance is also available by phone. The caller identifies itself as an AI assistant, calls may be recorded and transcribed, recordings are not used to train AI, and you can ask for a person at any time.
  • You can always reach a person - ask the assistant, or call Member Services at 888-777-9528.

2. What information it can use

Only your own information when you are signed in, and a dependent's information only if you are their authorized managing member. It is given the minimum information needed for what you asked. It cannot see other members' information. If you open the assistant from a link we sent you before you sign in, the chat is about the topic in that link, and the assistant may ask you to verify who you are before it discusses account or health information.

3. Our promises

  • We do not sell your health information.
  • We share it only as needed to deliver your care and the service - with the Providers, pharmacies, laboratories, payers and benefit providers involved in your care or your plan, and with the vendors we need to run the service. Our vendors work only for us, under written contract and Business Associate Agreements where required, and may use your information only to perform the service. Our AI vendors are contractually bound to zero retention of your information.
  • We do not use your health information to train AI models - ours or anyone else's. This covers your records, your chat conversations, and recordings and transcripts of visits, whether or not identifiers have been removed.
  • We do not use your health information for advertising.

The only exceptions are disclosures the law requires or permits without your authorization - for example, a court order, a public-health report, or preventing serious harm to a person - as described in our Notice of HIPAA Privacy Practices.

4. How long chats are kept, and who can see them

AI chat conversations are stored. A conversation that contains health information is part of your record and is retained for a MINIMUM of seven (7) to ten (10) years, longer where the law requires; we currently retain it indefinitely unless you ask us to delete it and the law permits deletion. The minimum for each kind of information is in the retention schedule in our Privacy Policy. Recordings and transcripts of AI voice calls are kept on the same basis. Chats may be seen by the Providers and authorized workforce members who need them for your care, support, security and quality - under access controls and audit logging - and by our contracted vendors only as needed to run the service.

5. Your rights

You have the HIPAA rights described in our Notice of HIPAA Privacy Practices - to see and copy your records (including chat content that is part of your record), to ask for corrections, to receive an accounting of disclosures, to request restrictions and confidential communications, to receive a paper copy of the notice, and to be notified of a breach. California residents have additional rights described in our Privacy Notice for California Residents. To exercise any right, contact us (section 8).

6. Human oversight, quality and safety

Licensed Providers make clinical decisions. Some enrollment questionnaires apply clinical eligibility rules set by our clinicians and may automatically indicate that a program or service isn't suitable for you; you can ask a Provider to review that result, or contact us at any time to speak with a person. The assistant does not make these decisions. We review AI performance for accuracy, safety, bias and harmful output, and we limit what the assistant can do to the tasks described above. If an answer seems wrong or unsafe, use the feedback option in the chat or contact us; we take reports seriously and you will not be retaliated against.

7. Security

Your information is encrypted in transit and at rest, access is limited to people who need it, and activity is logged. Vendors are held to the same standards by contract. If your information is ever breached, we will notify you as the law requires.
